DCM SUMMER SHOWDOWN CONTEST RULES

1. SPONSOR: The sponsor of all Contests administered on http://www.midnightsociety.com and companion handles or apps on mobile/Steam/Xbox/Playstation/Socials is Midnight Society (“Sponsor”), 55 E 3rd Ave San Mateo CA 94401.
   
2. APPLICABILITY: These Official General Rules apply to all Contests administered on http://www.midnightsociety.com and companion handles or apps on mobile/Steam/Xbox/Playstation/Socials. The details relating to specific entry requirements, drawing periods (including entry deadlines) and prize(s) to be awarded in each Contests (“Contests Details”), will be posted on the Midnight Society website and/or socials throughout the particular Contests.
   
3. Eligibility: The DEADROP DCM Summer Showdown Contest is only open to registered Midnight Society users who are 18 years or older as of their date of entry. Creating a Midnight Society account is free. This contest is subject to federal, state, and local laws and regulations and void where prohibited by law. Midnight Society’s employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees’ immediate family and/or those living in the same household of Employees are ineligible to participate in the DEADROP DCM Summer Showdown contest.
   
4. Sponsorship. The sponsor is Midnight Society (“Sponsor”), located at 55 E 3rd Avenue, San Mateo, CA 94401. Sponsor will conduct the contest substantially as described in these Official Rules.
   
5. Agreement to Rules: By entering this contest, the Entrant (“You”) agrees to abide by the Sponsor’s Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this contest, You represent and warrant that You are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this DEADROP DCM Summer Showdown Contest.
   
6. DEADROP DCM Summer Showdown Contest Entry Period: This contest submission begins on July 3, 2024 at 12:00am Pacific and ends on July 9, 2024 at 11:59pm Pacific (“Entry Period”). To be eligible for the contest, entries must be received within the specified Entry Period.
   
7. How to Enter: Eligible entrants can enter the DCM Summer Showdown by submitting their mode to Midnight Society. As a participant, your entry must fully meet all contest requirements, as specified in the Official Rules, in order to be eligible to win a prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor’s sole discretion. Entrants are allowed to submit multiple entries. Midnight Society reserves the right to disqualify entries that do not meet the contest conditions and requirements.

The exact method for submitting entries will be announced later in the event. Please stay tuned for further details on how to submit your mode to Midnight Society.

8. Prizes: The 4 Finalists of the DEADROP DCM Summer Showdown Contest (the “Finalist”) will receive a $500 event prize pool to run a Midnight Society sponsored tournament in their submitted custom DCM mode. Final voting will rank the DCM custom maps in order of; First place will receive $500, second place will receive $250, third place will receive $150, and fourth place will receive $100. The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. The Winner shall not transfer assignment of the prize to others, nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.
   
9. Odds: The total number of eligible entries received determines the odds of winning.
   
10. Selection and Notification of Winners: Four (4) Finalists(s) will be voted by the community via a voting page on MidnightSociety.com. The final ranking of the Four(4) Finalist(s) will be selected by a panel of judges assessing quality of submissions under the supervision of the Sponsor. The Sponsor will notify the Winner(s) by Twitter private message and/or email within seven (7) days following Winner selection. The Sponsor is not responsible for nor shall have no liability for Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall Sponsor be liable for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the prize within seven (7) days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited and an alternate Winner may be selected. Receipt of the prize (offered in the DEADROP Top Gameplay Clips Contest) by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
    
11. Rights Granted by You: By submitting an entry (e.g., text, video, photo, etc.) into this contest, You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image, statements about the DEADROP DCM Summer Showdown Contest, and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.
    
12. Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the DEADROP DCM Summer Showdown Contest should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the DEADROP DCM Summer Showdown Contest. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the contest or website or violate these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the DEADROP DCM Summer Showdown Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the contest rules; or the use of bots, macros, scripts, or other technical means for entering. Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the DEADROP DCM Summer Showdown Contest may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
    
13. Limitation of Liability: Your entry into this contest constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the contest and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.
    
14. GENERAL: Any attempt to deliberately damage any online entry or website or to undermine the legitimate operations of a Contests is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to disqualify such entrant and seek damages from such person to the fullest extent of the law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official General Rules, the Contests Details, or the rights and obligations of entrants and Sponsor in connection with a Contests shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of laws rules or provisions. Any disputes, claims or causes of action arising out of or relating to a Contests or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal or state courts located in or near San Mateo, California. Entrants waive any claim to consequential or punitive damages. Any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contests, but in no event attorney’s fees. Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising or publicity purposes, worldwide, and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Sponsor reserves the right, in its sole discretion, to disqualify from any Contests, and ban from any future promotions, any person it believes to have intentionally violated these Official General Rules or any Contests Details, or to be acting in an unsportsmanlike or disruptive manner, or to have tampered with any element of a Contests, without notice to the disqualified or banned person.

16. Social Media Platform: The contests hosted by Midnight Society are in no way sponsored, endorsed, administered by, or associated with Social media platforms on which Contests are conducted.
    
17. WINNERS LIST: To obtain the name of the winner for a particular Contest, send a self-addressed stamped envelope to: Midnight Society Inc 55 E 3rd Ave San Mateo CA 94401. Please specify “winners list” and the entry period for the particular Contest in your request.
